This book examines influential conceptions of sport and then analyses the interplay of challenging borderline cases with the standard definitions of sport. It is meant to inspire more thought and debate on just what sport is, how it relates to other activities and human endeavors, and what we can learn about ourselves by studying sport.

We surveyed selected physician members of the Society for Health and Human Values (SHHV) to study the benefits and problems of combining a medical career with a strong scholarly interest in the humanities. The 19 usable narrative responses characterized major benefits as experiential base and teaching opportunities. Barriers were numerous and fell under the general headings of: lack of time; lack of institutional rewards; lack of money for research and scholarship; lack of support from humanities peers; lack of suport from (...) medical colleagues; personal financial sacrifice; and lack of training. Some respondents offered creative solutions to these problems, including assertive negotiation of a job description, identification of helpful mentors, and various networking and administrative strategies. The survey results, while preliminary, suggest ways in which SHHV can assist clinicians who wish to develop a serious commitment to humanities study and teaching. (shrink)

Background If trials of therapeutic interventions are to serve society's interests, they must be of high methodological quality and must satisfy moral commitments to human subjects. The authors set out to develop a clinical - trials compendium in which standards for the ethical treatment of human subjects are integrated with standards for research methods. Methods The authors rank-ordered the world's nations and chose the 31 with >700 active trials as of 24 July 2008. Governmental and other authoritative entities of the (...) 31 countries were searched, and 1004 English-language documents containing ethical and/or methodological standards for clinical trials were identified. The authors extracted standards from 144 of those: 50 designated as ‘core’, 39 addressing trials of invasive procedures and a 5% sample of the remainder. As the integrating framework for the standards we developed a coherent taxonomy encompassing all elements of a trial's stages. Findings Review of the 144 documents yielded nearly 15 000 discrete standards. After duplicates were removed, 5903 substantive standards remained, distributed in the taxonomy as follows: initiation, 1401 standards, 8 divisions; design, 1869 standards, 16 divisions; conduct, 1473 standards, 8 divisions; analysing and reporting results, 997 standards, four divisions; and post-trial standards, 168 standards, 5 divisions. Conclusions The overwhelming number of source documents and standards uncovered in this study was not anticipated beforehand and confirms the extraordinary complexity of the clinical trials enterprise. This taxonomy of multinational ethical and methodological standards may help trialists and overseers improve the quality of clinical trials, particularly given the globalisation of clinical research. Howard Brody expresses concern that citing the “two cases that put futility on the map,” namely Helga Wanglie and Baby K, may be providing ammunition to the opponents of the concept of medical futility. He in fact joins well-known opponents of the concept of medical futility in arguing that it is one thing for the physician to say whether a particular intervention will promote an identified goal, quite another to say whether a goal is worth pursuing. In the latter (...) instance, physicians are laying themselves open “to the criticism of taking on basic value judgments that are more appropriately left to patients and their surrogates.” Brody states that in both the Wanglie and Baby K cases, the “basic value judgments” had to do with the worthiness of maintaining unconscious life via medical technology. He classifies this as “a question of professional integrity—but not a question of futility,” adding that “more than semantics hinges on this distinction.” The “more than semantics” factor is a pragmatic, even political one. Failure to make this distinction renders physicians “that much more suspect and less trustworthy in the public debate.”. (shrink)

Combining the liberalism of Locke and the "civic humanism" of Republicanism, Mary Wollstonecraft explored the need of women for coed and equal education with men, economic independence whether married or not, and representation as citizens in the halls of government. In doing so, she foreshadowed and surpassed her much better known successor, John Stuart Mill. Ten feminist scholars prominent in the fields of political philosophy, constitutional and international law, rhetoric, literature, and psychology argue here that Wollstonecraft, by reason of the (...) scope and complexity of her thought, belongs in the "canon" of political philosophers along with Rousseau and Burke, her contemporaries, both of whom she strenuously engaged in political debate. These essays explore the many aspects of her thought that resound so tellingly to the modern woman, including her groundbreaking attempt to be completely self-sufficient. The final bibliographical essay outlines the changing interpretations of Wollstonecraft's work over the past two hundred years and evaluates her standing among political theorists today. Defending Life is arguably the most comprehensive defense of the pro-life position on abortion - morally, legally, and politically - that has ever been published in an academic monograph. It offers a detailed and critical analysis of Roe v. Wade and Planned Parenthood v. Casey as well as arguments by those who defend a Rawlsian case for abortion-choice, such as J. J. Thomson. The author defends the substance view of persons as the view with the most explanatory power. The substance (...) view entails that the unborn is a subject of moral rights from conception. While defending this view, the author responds to the arguments of thinkers such as Boonin, Dworkin, Stretton, Ford and Brody. He also critiques Thomson's famous violinist argument and its revisions by Boonin and McDonagh. If the slogan "No entity without identity" might be said to encapsulate the new essentialism, it has in any case been felt to serve the working ontologist as a powerful tool for ruling out certain dubious entities. The first half of Baruch Brody’s book consists in a radical "critique of this whole philosophical tradition," as it is seen to be "based upon a fundamental erroneous assumption," namely that "the truth-conditions of claims concerning identity vary as the type of entity (...) in question varies." In fact no such parochial identity conditions need be invoked according to Brody, seeing that the Principle of the Identity of Indiscernibles will suffice to define identity in omnibus fashion across the board, even to the extent of being "understood by those who want to learn the meaning of ‘identity'.". I argue that the distinction which is current in much writing on medical ethics between autonomous and non-autonomous patients cannot cope comfortably with weak-willed patients. I describe a case involving a patient who refuses a blood transfusion even though he or she agrees that it would be in his or her best interests. The case is discussed in the light of the treatment of autonomy by B Brody and R Gillon. These writers appear to force us to treat an (...) incontinent patient either as autonomous, just like a rational agent whose decisions are in accordance with his beliefs or as non-autonomous, like comatose patients or children. Though neither is entirely satisfactory I opt for describing such patients as autonomous but point out that in cases like this the principle of respect for autonomy does not give a determinate answer about how the patient ought to be treated. A response to a commentary by Howard Brody and Luana Colloca about “What's Not Being Shared in Shared Decision‐Making?” from the July‐August 2013.

In The Healer's Power, Howard Brody placed the concept of power at the heart of medicine's moral discourse. Struck by the absence of “power” in the prevailing vocabulary of medical ethics, yet aware of peripheral allusions to power in the writings of some medical ethicists, he intuited the importance of power from the silence surrounding it. He formulated the problem of the healer's power and its responsible use as “the central ethical problem in medicine.” Through the prism of power (...) he refracted a wide range of ethical problems, from informed consent to truth-telling, from confidentiality to futility, from the physician's fantasies to the physician's virtues. At times this prism shed new light on old problems, enabling us to see from an unexpected angle the elements of which the problem was composed. At other times it exposed issues of ethical significance that had been neglected in the bioethics literature. (shrink)

In a recent issue of CambridgeQuarterlyofHealthcareEthics, Howard Brody and Lawrence Schneiderman offer contrasting opinions about how to apply the concept of in medicine. Brody holds that are those in which it is reasonably certain that a given intervention when applied for the purpose of attaining a specific clinical goal. To determine which actions are futile, Brody prescribes a division of labor. Patients are charged with choosing the goals of treatment while physicians are charged with determining whether specific (...) treatments will be effective in achieving these goals. Though physicians do not choose specific goals, Brody thinks they have a prerogative to decide whether they can, in good conscience, aid in the achievement of specific patient goals. Let us use to denote choosing between alternative goals and to denote choices about whether one will assist in the pursuit of particular goals. Brody's position is essentially that patients are positive validators and that physicians are negative validators. Brody concludes that treatments that are effective in achieving patients' goals are not futileFutilitypromote a goal that both agree is desirable.”. (shrink)

The idea that immoral behaviour can sometimes be admirable, and that moral behaviour can sometimes be less than admirable, has led several of its supporters to infer that moral considerations are not always overriding, contrary to what has been traditionally maintained. In this paper I shall challenge this inference. My purpose in doing so is to expose and acknowledge something that has been inadequately appreciated, namely, the moral aspect of nonmoral goods and evils. The topic is what limits there are on the counterfactual possibilities for individuals: in other words, what essential properties, if any, they have. ;In Chapters 3-6 three answers to this question that have been given in recent philosophical literature are examined. They are: that each thing has a unique individual essence ; (...) that there are features of the origin of an individual without which it could not possibly have existed ; and, finally, that there are sortal concepts that represent essential properties of the things that fall under them . ;All of these answers, and many of the arguments that have been given for them, are criticised. Sometimes the criticism takes the form of pointing to unpalatable consequences that result from the acceptance of the doctrine in question. Sometimes the criticism consists in pointing to difficulties or inadequacies in the arguments that have been presented in its favour. ;A preliminary chapter prepares the ground by setting out the conceptual framework, and the chief formal characteristics, of the essentialism discussed in the later chapters. Chapter 2 discusses the nature of necessary a posteriori truth, touching on questions in the philosophy of language and mind concerning the notion of de re thought. ;It is argued that essentialism about natural kinds raises problems of its own: some of these are discussed in Chapters 7 and 8. Here the main topic is the connection between semantic theory and natural kind essentialism. Author’s Introduction Intuitively, George Clooney could lose a finger and he would still be him. Also intuitively, he could not lose his humanity without ceasing to be altogether. So while he could have one less finger, he could not be other than human. These intuitions suggest that (...) there are two kinds of properties: on the one hand, there are essential properties and, on the other, there are accidental properties. Essentialism is the view that captures those intuitions and claims that some of an object’s properties are essential and some are accidental. Essential properties are often appealed to in metaphysical arguments. Consider the famous Goliath–Lumpl example. Goliath is a clay‐statue, and Lumpl is the piece of clay from which Goliath is made. Are Goliath and Lumpl the same entity, or are they distinct, despite coinciding in the same spatial region (at least for a period of time)? An argument in favour of their distinctness appeals to essential properties. Let s be Goliath’s shape. Lumpl’s current shape is therefore also s. It seems that Lumpl could lose its current shape and still exist. Yet, if Goliath – the statue – were melted, for instance, it would cease to exist. Behind this reasoning is the belief that having shape s is essential to Goliath but not to Lumpl. Goliath and Lumpl can therefore be distinguished by their essential properties. Consequently, and by Leibniz’s Indiscernibility of Identicals– according to which identicals cannot be distinguished – Goliath and Lumpl are distinct objects. The essentialist intuition appealed to in this argument is that shapes are essential to statues but not to pieces of clay. Of course, this particular argument – like any other – can be resisted. It is all the same a good illustration of how essentialism is put to work in metaphysics. A good understanding of the broad phenomenon of essentialism is therefore an unavoidable task, since the credit of a lot of metaphysical arguments partially depends on it. With this book – which is, among other things, a defence of a Direct Theory of Reference – Kripke rescues, after Quine’s powerful attacks against it, and using the semantic rigidity of proper names, (Aristotelian) essentialism. Mackie, Penelope. How Things Might Have Been: Individuals, Kinds and Essential Properties. Oxford: Clarendon Press, 2006. An extremely valuable recent contribution to the field. Here, Mackie defends that, although essentialism is a real phenomenon, there are much fewer essential properties than is standardly believed, and labels this view ‘Minimalist Essentialism’. Beyond the intrinsic interest of the defence of Minimalist Essentialism, the book is also highly recommended for its clear reconstructions – and discussions – of some of the most influential essentialist arguments. In addition, the book’s bibliography is very comprehensive and updated, and it might be a useful resource for students. Plantinga, Alvin. The Nature of Necessity. Oxford: OUP, 1974. Yet another foundational work. Here, Plantinga offers his essentialist theory which, like Forbes’, also incorporates individual essences although of a very different sort from Forbes’. Plantinga believes in purely non‐qualitative individual essences, whereas Forbes’ aims at purely qualitative ones. The book is also excellent to provide a solid background to those unfamiliar with the topic. This is one of the two papers this guide accompanies. It contains a comparative examination of two opposed responses to the problem of possibilia. One solution crucially appeals to individual essences and another – compatible with them, but not dependent on them – makes existence a necessary‐whenever‐possible property. Salmon, Nathan. Against what Kripke’s Naming and Necessity might have induced us to believe, Salmon’s Reference and Essence argues that essentialism cannot be derived from the Direct Theory of Reference. Our commitments to essentialism should therefore come from somewhere else. It also contains one of the most cited and influential arguments against the transitivity of the accessibility relation between worlds, which relies on flexible essential properties. Focus Questions • There is a debate as to whether essential properties– as well as individual essences and sufficient‐for‐existence properties– should be specified in purely qualitative terms or whether, by contrast, non‐purely qualitative – or even purely non‐qualitative – specifications are allowed. What are the main arguments against the availability of purely qualitative specifications? • Flexible essential properties seem to be more plausible than non‐flexible ones. Yet, together with sufficient‐for‐existence properties, they imply flexible individual essences. How plausible are these? Should we revise our intuitions supporting flexible essential properties? • What are, ultimately, the ontological differences between a necessitist approach to possibilia and an individual‐essences‐based approach? • According to necessitism, essential properties do not impose necessary conditions for an object’s existence. Can the necessitist, nonetheless, capture this role of essential properties by saying that, when it comes to possibly concrete entities, essential properties provide necessary conditions for an object’s concreteness?
